Can't establish Subba's Nepal origin: CBI to SC

New Delhi, August 14:Controversial Congress MP Mani Kumar Subba's ''Nepali
origin'' could not be ascertained, the Central Bureau of Investigation (CBI)
has told the Supreme Court.
In its secret report filed in the apex court, the CBI has stated that one
Maniraj Limbo was a ''life convict'' in Nepal but ''it was not confirmed''
whether Subba and Maniraj Limbo were one and the same. The report was
submitted in response to a PIL alleging the MP was a murder convict, and
accusing him of impersonation, lottery scandal and funding of militant
outfits in the North-East.
Ambhoj Sinha, counsel for the petitioner, contending that Subba was a Nepali
citizen and a voter in Kathmandu who was still on the voter list there, had
sought a thorough probe. A Bench presided over by Chief Justice of India
(CJI) Y K Sabharwal had issued notices to the Centre, Union Home Ministry,
CBI, Election Commission and a couple of north-eastern states.
The CBI report stated that a ''preliminary inquiry'' was conducted into the
matter after former joint secretary in the Home Ministry in charge of the
North-East G.K. Pillai had complained that:
a) Subba is a Nepali national;
b) he is a prisoner absconding from Nepal;
c) he has paid, through his lottery agency, money to the Government of
Peoples Republic of Nagaland, a banned organisation; and
d) he has committed large-scale fraud in running his lottery business and
made illegal financial gains.
The report filed by K Y Guru Prasad, Deputy Superintendent of Police, CBI,
states that Subba is thrice-married and two of his wives live with him.
It says ''fingerprints/identification marks of convict Mani Raj Limbo in
Nepal were not provided by the Nepalese authorities''. Ironically, the
investigating agency could not even get the reports of the vigilance and
state police of Sikkim, which had concluded that ''Mani Kumar Subba was a
foreign national''.
The Sikkim police report ''could not be obtained in course of the inquiry
and thereafter, the same was reported to be untraceable by the authorities
concerned''.
The CBI also contradicted itself in its report that ''Interpol Kathmandu
(had) initially confirmed that Mani Raj Limbo alias Mani Kumar Subba was
undergoing life imprisonment in a case of murder and that he had escaped
while being taken to Elam Hospital from Elam Jail (in Nepal) some time in
1973''.
Sinha contended that this was the period when Subba entered India and stayed
in Assam and other north-eastern states and was later elected to the Lok
Sabha from the Tezpur constituency of Assam.
On the lottery scandal, the CBI said inquiry could not be made because it
required the ''concurrence'' of the Nagaland government.
However, the CBI appended an earlier inquiry report according to which the
Nepal government replied ''query is positive'' (meaning Nepal confirmed) to
a question ''whether Mani Raj Limbo alias Mani Kumar Subba was a resident of
Somangkhu village in Tamarkhola area of Taplejung district in eastern
Nepal''.
The report also stated that the Nepal government had on ''24.8.2028
(according to Nepali calender) stated that he was awarded life imprisonment
in a murder case'' and added that the Nepal government said ''query is
positive'' on the question of his escaping from the Elam Jail around 1973.
Further hearing in the case will be in September.
