Ruling Sets Stage for E-Mail Trial

November 2, 2001

By CARL S. KAPLAN

Earlier this week the United States Supreme Court declined
to review a Seattle case involving a state's ability to
enforce its own Internet law in borderless cyberspace.

As a practical matter, the decision set the stage for
what's sure to be an interesting trial in Washington's King
County later this year. Jason Heckel, an entrepreneur from
Salem, Oregon, has been accused by Washington's attorney
general of sending unsolicited commercial e-mail in
violation of a local law designed to prevent such
"spamming."

But the impact of the high court's action might have wider
implications, lawyers say -- though how much is a matter of
debate.
